According to Victorian law, temporary fencing is mandatory during any construction where a pool or spa contains—or has the potential to accumulate—more than 300mm (30cm) of water. This temporary fencing requirement is in place to ensure adequate safety and prevent children from accessing the area unsupervised.
It applies to all construction or excavated sites where a pool is to be installed. The responsibility for maintaining the temporary fencing barrier is shared between the homeowner and the builder, making compliance essential for both parties.
